Privacy policy

1. Introduction

This privacy policy (“Policy”) sets out the manner in which Rizort, Inc., a Delaware corporation having its principal place of business at 908 Constitution Drive, Foster City, California 94404 (“Company”, “we”, “our”, “us”) collects, uses, maintains and shares information about you (“you” or “your”) through the Company’s website, mobile application and virtual reality applications (collectively, the “Online Interfaces“) in order to provide the Company’s services (the “Services“).

In the course of your use or access of the Services, the Company may collect distinct categories of information from you. This Policy informs you of the types of information that may be collected and the manner in which such information is collected, used, processed, disclosed and maintained. This Policy must be read in conjunction with the other agreements you enter into with the Company and the Terms of Use (as published on the Company’s website at rizort.com/terms and as updated from time to time).

PLEASE READ THIS POLICY CAREFULLY. YOUR USE OR ACCESS OF THE SERVICES SHALL CONSTITUTE YOUR AGREEMENT TO THIS POLICY. IF YOU DO NOT AGREE WITH THIS POLICY, PLEASE DO NOT USE OR ACCESS THE COMPANY’S SERVICES. By accepting this Policy, you expressly consent to the Company’s use and disclosure of your personal information in accordance with this Policy.

2. Applicability of the policy

This Policy shall apply to all information the Company collects in the course of your use of the Services. This Policy does not apply to, nor does the Company take any responsibility for, any information that is collected by any third party.

3. Information we collect

The following types of information may be collected by the Company:

(a) We will collect the following information:

(i) any personal information that you may submit or may be required to submit for registration, receipt and continued use of the Services;

(ii) your email address, name, date of birth, gender, income group, personal, professional information, travel related preferences, interests and travel companion information may be collected to customize the Services;

(iii) any personal or sensitive personal information of any other individual that you provide in the course of using the Services; and

(iv) any other information you may choose to provide us, including any information to update your account and profile, to fill out any forms and to provide your feedback to surveys.

(b) Your calls to and from the Company’s help desk/customer service desk may be recorded or monitored for internal training and quality control purposes, and such call logs shall be maintained for such period as reasonably necessary in the Company’s discretion.

(c) The Company will collect information through automatic tracking, irrespective of whether you have created an account with us or not. Such automatically collected information may include: your interactions with the Online Interfaces, such as the viewed pages, your searches for listed destinations, nature of search, any bookings made, IP addresses, details of your computer system, device id, browser, location, connections or any information that the Company may collect through the use of cookies and other tracking technologies. The collection of data may, in most cases, be automatic.

(d) “Cookies” are files placed in your computer system’s or device’s hard drive and browser and are intended to improve your use of the Online Interfaces, by enabling us to track your preferences, a history of the pages you view, time and date, advertisements, links that you visit and other user information. You may decline these cookies by changing your settings. However, please note that changing your settings may impact certain features of the Services. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Online Interfaces. Persistent cookies can be removed using tools available in some browsers. You can opt-out of such collection and use of information for ad targeting and other reasons.

(e) We will collect information received from social networking sites linked with your account and combine it with your account information. For example, if you access or login to our Online Interfaces via a third-party source like Facebook, Twitter and LinkedIn, we may receive your registration information, updated delivery and address information, purchase history and demographic information. If you request the Company to delete any and all of your information received from such social networking sites, the Company shall abide by such requests. Notwithstanding the forgoing, we will have a right to retain one copy of your information if required to keep it by law, regulation or separate agreement with us.

4. Use of your information

4.1. The information that we collect will be used for the following purposes:

(a) operating, improving, optimizing, developing and administering the Online Interfaces;

(b) facilitating your use of the Online Interfaces by allowing you to communicate with other subscribers or members, by customizing your experience, by grading search results or tailoring advertisements on the basis of search results, history of bookings and such other selections/preferences;

(c) providing you with promotional mails/posts, new deals, campaigns, advertising and other information of interest to you based on your communication preferences;

(d) analysis of the use of the Online Interfaces and the Services, such as conducting such market research and surveys to understand and determine preferences, analysing customer location and demographics to develop and offer special deals and marketing programs in connection with our Services;

(e) rendering Services to you;

(f) for processing and administering referral programs, rewards, contests, or other promotional activities or events sponsored or managed by the Company or its third-party network partners;

(g) resolving disputes and troubleshooting any other problems,

(h) risk assessment and conducting investigations;

(i) prevention of any kind of abuse, such as fraud, spam, security breach, and for detection and prevention of any illegal activities; and

(j) any other reasons in connection with the provision Services to you, to enforce our Terms of Use and payment terms, to ensure compliance with legal requirements and other policies.

4.2. You agree that the Company may use your personal information to contact you and deliver information, to render Services and to deliver targeted advertisements, administrative notices and any other communication relevant to your use of the Online Interfaces.

5. Disclosure of your information

5.1 General. The information we collect about you may be disclosed by the Company in the circumstances described below. Personal information may be transferred and/or accessed in countries outside the European Economic Area (EEA), including the United States.

(a) In Connection with the Services. Provision of the Services to you may require that we share certain personal information with third parties involved in the provision of Services. Such third parties may include hotels, tour providers, experience providers, transportation providers and advertisers.

(b) Subsidiaries and Affiliates. We may share personal information with our subsidiaries, affiliates and third parties for the purposes for which you provided the information or as reasonably necessary for our internal administrative and business purposes.

(c) Consent. We may share personal information in accordance with any consent you provide.

(d) Required by Law. We may disclose personal information, or any information collected through this Site if we are required to do so by law (e.g., for purposes of completing required verifications for provision of the Services to you) or pursuant to legal process, in response to a request from government officials or law enforcement authorities, or as necessary or appropriate in connection with an investigation of illegal activity.

(e) Certain Transactions. We may disclose or transfer personal information, or any information collected through the Online Interfaces to third parties who acquire all or a portion of our business, whether such acquisition is by way of merger, consolidation or purchase of all or a portion of our assets, or in connection with any bankruptcy or reorganization proceeding brought by or against us.

(f) Aggregate Information. The Company may use personal information for market reports and other purposes provided that only anonymous, aggregated data is disclosed.

6. Payment security

In connection with the paid Services, the Company uses payment providers like Stripe (“Payment Partner”) who are audited and are compliant with Payment Card Industry Security Standards (“PCI DSS”) to receive payments from you. Notwithstanding anything to the contrary, the Company is not responsible or liable for the availability or accuracy of such Payment Partner services, or the content, products, or services available from such Payment Partner services.

7. Data security

The information that you provide, subject to disclosure in accordance with this Policy, shall be maintained in a safe and secure manner. Your information shall be protected, to a commercially reasonable extent, against unauthorized access, use or disclosure. The Company’s databases and information are stored on secure servers with appropriate firewalls. While the Company will use all reasonable efforts to ensure that any information collected from you or are generated by your use of the Online Interfaces or the Services is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable.

8. Integration with third party website

Links to external, or third-party websites, may be provided solely for your convenience. Such links from us to an external website does not imply or mean that the Company endorses or accepts any responsibility for the content or the use of such website. The Company does not give any representation regarding the quality, safety, suitability or reliability of any external websites or any of the content or materials contained in them. It is important for you to take necessary precautions, especially to ensure appropriate safety from viruses, worms, Trojan horses and other potentially destructive items. When visiting external websites, users should review those websites’ privacy policies and other terms of use to learn more about, what, why and how they collect and use any personally identifiable information.

9. Accessing and updating your information

You can change, alter or otherwise modify or update the information submitted by you at any time by accessing the Online Interfaces and authenticating yourself by using your registered username or accessing your user account. You may also change and/or delete any of the information you have submitted. The Company reserves the rights to retain any information regarding your usage of the Online Interfaces and the Services of the Company, and you are not entitled to require the Company to delete the same. The Company at its sole discretion may permit or deny the change of any information, if it reasonably believes that the same is required to observe its obligations under applicable laws.

You may cancel your account subject to cancellation terms and conditions provided in Rizort Terms of Use at rizort.com/terms. However, information that you have shared with others by providing feedback or reviews or other postings may continue to be publicly visible in your name even though your account is cancelled.

10. Age restrictions

The Online Interfaces are only intended for users who are over the age of majority in the country in which they reside, unless represented by a parent or legal guardian. If you are not of the requisite age, you must not provide any information to the Company whether directly or by way of usage of the Online Interfaces. If the Company determines that it is in possession of any information belonging to an individual below the age of majority which is submitted, collected or generated in breach of the terms of this Policy, it will delete the same without any notice to the individual to whom such information belongs to.

11. Amendments to the privacy policy

This Policy is subject to change at the Company’s sole discretion. Any changes to the Policy will be notified by a notice at rizort.com/terms/privacy.

12. Data protection directive

The Site is currently hosted at Amazon Web Services but that may change without notice to you. Residents of the EU: you have the right to obtain certain information about the processing of your personal data through a Subject Access Request (as defined in the Data Protection Act 1998). In circumstances where the processing of your personal data is not in compliance with applicable national data protection laws, you may also request rectification, erasure or blocking of your personal data. We shall not retain or process personal data for longer than is necessary. However, if the data is retained, we shall continue to retain personal data in accordance with any statutory or professional retention periods applicable in their respective countries and/or industry.

We shall only transfer the personal data to a third party by using secure methods. For the purposes of this clause, transfers of personal data shall mean any sharing of personal data by us with a third party, and shall include, but is not limited to, the following:

(a) storing personal data on servers outside the EEA.

(b) subcontracting the processing of personal data to data processors located outside the EEA.

(c) granting third parties located outside the EEA access rights to the personal data.

This policy shall be governed according to governing law and jurisdiction defined in Rizort Terms of Use at rizort.com/terms

14. Compliants

If you have any issue or grievance with respect to our Policy or with the manner in which we collect or store your information, or in any respect related to your personal information provided to us, please contact info@rizort.com. We will do everything we reasonably can to ensure that your grievance is attended to and addressed within a period of thirty (30) days from the date of receipt of your grievance.
